1. Acceptance of Terms
By accessing or using Neurture ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and Neurture. Please read them carefully before using our platform.
2. Account Terms
- Age requirement: You must be at least 18 years old to create an account and use our Service.
- Account security: You are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized use of your account.
- Accurate information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
- One account per person: Each person may only maintain one account. Creating multiple accounts may result in termination of all accounts.
- Non-transferable: Your account is personal to you and may not be transferred or shared with others.
3. Subscription & Billing
Free Trial
- New subscribers are eligible for a 7-day free trial
- You may cancel at any time during the trial without being charged
- If you do not cancel before the trial ends, your subscription will automatically begin
Subscription Pricing
- The monthly subscription fee is $14.99 USD
- The yearly subscription fee is $119.99 USD (save 33%)
- Prices are subject to change with 30 days notice
- All prices are exclusive of applicable taxes
Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for the renewal.
Cancellation
- You may cancel your subscription at any time through your account settings
- Upon cancellation, you will retain access until the end of your current billing period
- We do not provide prorated refunds for partial months
Refund Policy
Generally, subscription fees are non-refundable. However, we may consider refunds on a case-by-case basis for extenuating circumstances. Please contact support for assistance.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You may NOT:
- Share your account credentials with others
- Use the Service for any commercial purpose without authorization
- Attempt to gain unauthorized access to any part of the Service
- Use automated means to access or collect data from the Service
- Interfere with or disrupt the Service or servers
- Upload viruses or malicious code
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users or creators
5. Content Restrictions
Guides (PDFs)
- Guides are for viewing within the app only
- Downloading or printing guides is not permitted
- Screenshots or screen recordings of guides are prohibited
Tools & Printables
- Tools and printables may be downloaded for personal, non-commercial use only
- You may print materials for use with your own family
- Redistribution or resale of materials is strictly prohibited
Audio Content
- Audio content is for streaming within the app only
- Recording or downloading audio files is not permitted
- Public performance of audio content is prohibited
6. Intellectual Property
All content on Neurture, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of Neurture or its content creators and is protected by copyright, trademark, and other intellectual property laws.
- Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the content for personal purposes
- You may not copy, modify, distribute, sell, or lease any part of our Service or content
- You may not reverse engineer or attempt to extract source code from our software
- All rights not expressly granted are reserved
7. Creator Terms
If you are a content creator on our platform, the following additional terms apply:
- Content ownership: You retain ownership of content you create, but grant Neurture a license to display, distribute, and promote your content on our platform
- Content standards: All content must follow our Creator Guidelines and adhere to evidence-based ABA practices
- Revenue sharing: Eligible creators may participate in our engagement-based revenue sharing program, subject to separate Creator Guidelines
- Moderation: We reserve the right to remove or modify content that violates our guidelines or these Terms
- Credential verification: You agree to provide accurate credential information and understand that false claims may result in account termination
8. Disclaimer & Limitation of Liability
Educational Purpose Only
The resources and information provided on Neurture are for educational and informational purposes only. They are NOT a substitute for professional therapy, medical advice, or mental health treatment.
No Guarantees
We do not guarantee any specific outcomes from using our resources. Every child and family is unique, and results may vary.
Limitation of Liability
To the maximum extent permitted by law, Neurture and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Service Availability
We strive to provide uninterrupted access to our Service, but we do not guarantee that the Service will be available at all times. We reserve the right to modify, suspend, or discontinue the Service at any time.
9. Termination
- By you: You may cancel your subscription and close your account at any time through your account settings
- By us: We may terminate or suspend your account immediately, without prior notice, for violations of these Terms
- Effect of termination: Upon termination, your right to use the Service will cease immediately. Any data associated with your account may be deleted
- Survival: Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of Canada.
